Orders are not binding upon Advantage Land Company (ALCO) until accepted by ALCO. Invoices are due and payable the next business day following the close of auction by 4pm CST unless otherwise explicitly mentioned in Auction Details and/or Payments. The Customer is responsible for sales tax, applicable fees, and all other taxes associated with the order. ALCO collects South Dakota sales tax on the total purchase price, which includes the buyer premium. ALCO requires any major credit card to verify the customer’s payment ability prior to bidding. During the process of bidder verification, a hold will be placed on the customer’s credit card. If the total amount of the sale is less than $750 dollars this credit card will also be used to pay for the item(s). A 3% fee will be added to all credit card transactions. Any transactions greater than $750 dollars can be paid with an E-check, bank wire, cashier’s check, or cash. If paying by check, checks must be made out and addressed to: Advantage Land Company, 517 6th Street, Brookings, South Dakota 57006. When paying by check or cashier’s check or bank wire, a customer’s credit card will only incur an actual charge in the event of non-payment. Customers can arrange specific payment types by calling ALCO prior to or during the bidding process at 605-692-2525 during normal business hours, or can be directed to info@advantagelandco.com on weekends or weekdays after 5pm CST. If you are from another country, you must pay in US funds.

Failure to pay by the payment deadline noted in these terms and conditions will result in an additional forfeiture fee equal to 15% of the winning bid price plus storage fees of $25/day until the asset is ultimately removed from the auction site. ALCO reserves the right to charge the credit card on file. After the payment deadline ALCO may also declare the asset abandoned resulting in additional costs and potential losses to the buyer. ALCO reserves the right to cancel said if invoices are not paid according to terms. Defaulting customers will lose all bidding privileges with ALCO.

ALCO charges a $30.00 returned check fee and no stop payments will be honored.

Customer agrees and acknowledges that all purchases on the website are sold “AS-IS” and “WHERE-IS” unless otherwise explicitly stated. In cases where the lot explicitly states that the item can be shipped, customer agrees to pay all applicable shipping costs and fees related to shipment of the item(s). Removal of property shall be at the expense, liability, and risk of the customer. Purchases will be available for pick up only on presentation of paid bill. ALCO shall not be responsible for goods not removed within the time specified and shall have the option of removing and storing or reselling at the expense and risk of the customer any article purchased and not picked up within the specified time allotted. NO LOT OR ITEM MAY BE TAKEN FROM ORIGINAL OWNER PREMISES UNTIL PAYMENT HAS BEEN RECEIVED IN THE FULL AMOUNT TO ALCO. The Customer assumes all risk and liability when removing equipment from the original owner’s premises. This risk and liability includes, but is not limited to: damage of property owned by either original owner or Customer, bodily injury of the Customer, and any/all other damages, injuries, loss of equipment, business losses, monetary losses, or loss of life during the course of equipment removal. All customers release ALCO from liability and neither ALCO nor his principal shall be liable by reason of any defect in or condition of the premises on which the sale is held.

Absolutely no returns on sales. All sales are final. By bidding the customer assumes all risk and liability for the condition, wear, quality, and appearance of the item. The customer assumes all responsibility in ensuring that the item they are bidding on meets their standard whether inspected in person or online. ALCO reserves the right to withdraw or relist an item. ALCO reserves the right to re-open the bid as a result of discrepancies in the bidding process. ALCO reserves the right to sell items absolute or with a reserve at their client’s discretion. Any ready, willing and able buyer has the right to bid, including the seller and ALCO on behalf of the seller. The decision of ALCO shall be final and absolute in the settling of any/all disputes that may arise before, during, or after the auction process. ALCO shall not be responsible for the correct description, authenticity, or defect in any lot, and makes no warranty in connection therewith. No allowance will be made, or sale set aside on account of any incorrectness, error in cataloging, or any imperfection not noted. No deduction will be allowed on damaged items. 7% buyer premium added to each lot with a cap of $800, resulting in total purchase price. Announcements made day of the sale take precedence over all written material.

BY PURCHASING A GUN, YOU CERTIFY:

YOU are not prohibited by Federal or State law, or local ordinance, from receiving firearms or ammunition, or ammunition components, of any kind.

YOU are at least eighteen (18) years of age if purchasing long guns or long gun ammunition or ammunition components.

YOU are at least twenty-one (21) years of age if purchasing a handgun or ATF-defined “OTHER” firearm (including, but not limited to, stripped receivers, frames, and pistol-grip shotguns_ OR ammunition or ammunition components for use in handguns.

YOU are the actual transferee/buyer of the firearm(s) you are purchasing from ALCO. WARNING: you are NOT the actual buyer if you are acquiring the firearm(s) on behalf of another person.

YOU are not under indictment or information in any court for a felony, or any other crime, for which the judge could imprison you for more than one year.

YOU have not been convicted in any court of a felony, or any other crime, for which the judge could have imprisoned you for more than one year, even if you received a shorter sentence including probation.

YOU are not a fugitive from justice.

YOU are not an unlawful user of, or addicted to, marijuana or any depressant, stimulant, narcotic drug, or any other controlled substance.

YOU have not been adjudicated mentally defective (which includes a determination by a court, board, commission, or other lawful authority that you are a danger to yourself or to others or are incompetent to manage your own affairs, OR have not been committed to a mental institution.

YOU have not been discharged from the Armed Forces under dishonorable conditions.

YOU are not subject to a court order restraining you from harassing, stalking, or threatening your child or an intimate partner or child of such partner.

YOU have not been convicted in any court of a misdemeanor crime of domestic violence.

YOU have never renounced your United States citizenship.

YOU are not an alien illegally in the United States.

YOU are not currently on Federal NICS or State agency “DELAY” or “DENIED” status regarding your most recent attempt to purchase a firearm. Firearm and/or ammunition or ammunition component sales or transfers are prohibited during these conditions.
